• "GathrUp", "we", "our", or "us" refers to the GathrUp platform and its operators.
• "User", "you", or "your" refers to any individual or entity accessing or using GathrUp.
• "Event Host" refers to a user who creates and manages events.
• "Guest" refers to an invitee or participant in an event.
• "Content" includes text, images, videos, messages, invitations, event details, and any other materials uploaded or generated on the platform.
• "Services" refers to all features, tools, and functionalities offered by GathrUp.

2. Eligibility and Account Registration

You must be at least 16 years old to create an account. By registering, you confirm that all information provided is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

GathrUp reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Platform Purpose and Scope

GathrUp provides tools for event planning, invitations, guest management, RSVPs, scheduling, notifications, media sharing, and related event coordination features.

GathrUp is not responsible for the execution, safety, legality, or outcomes of events created using the platform. All events are independently organised by users.

4. User Responsibilities

You agree to:

• Use the platform lawfully and respectfully
• Ensure event details are accurate and not misleading
• Obtain consent before inviting guests or sharing their information
• Refrain from uploading harmful, illegal, offensive, or infringing content
• Respect the privacy and rights of other users

You must not use GathrUp to facilitate harassment, fraud, spam, unlawful gatherings, or any activity that violates applicable laws.

5. Content Ownership and Licensing

You retain ownership of the content you upload. By uploading content to GathrUp, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and process that content solely for the purpose of providing the Services.

You confirm that you have the necessary rights and permissions to upload any content you share.

6. Media, Photos, and Memories

GathrUp allows users to upload photos, videos, and other media related to events. You are solely responsible for the content you upload and for obtaining consent from individuals appearing in such media.

GathrUp does not monitor or moderate media in real time but reserves the right to remove content that violates these terms or applicable laws.

7. Invitations, RSVPs, and Notifications

GathrUp facilitates invitations and RSVPs but does not guarantee delivery, response rates, attendance, or guest behaviour. Notification delivery may be affected by device settings, network issues, or third-party service limitations.

8. Third-Party Services

GathrUp may integrate with third-party services such as email providers, SMS services, calendar tools, authentication providers, or analytics platforms. We are not responsible for the availability, accuracy, or reliability of such services.

Your use of such services is subject to their respective terms and policies.

9. Data Protection and Privacy

Your use of GathrUp is subject to our Privacy Policy, which explains how we collect, use, and protect personal data. By using the platform, you consent to such processing in accordance with applicable law.

10. Prohibited Activities

You must not:

• Reverse engineer or attempt to access source code
• Interfere with platform security or functionality
• Use automated tools without authorisation
• Impersonate others or misrepresent affiliations
• Upload malicious code or harmful content

Violation may result in immediate suspension or termination.

11. Suspension and Termination

GathrUp may suspend or terminate access at any time if you violate these Terms, misuse the platform, or pose a risk to other users or the platform.

You may stop using the service at any time and request account deletion, subject to legal retention obligations.

12. Disclaimers

GathrUp is provided "as is" and "as available." We make no guarantees regarding uninterrupted access, error-free operation, or suitability for a specific purpose.

Events, guests, communications, and outcomes are the sole responsibility of users.

13. Limitation of Liability

To the maximum extent permitted by law, GathrUp shall not be liable for indirect, incidental, consequential, or special damages arising from your use of the platform, including loss of data, revenue, or reputation.

Our total liability shall not exceed the amount you paid to use the service, if any, in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless GathrUp from claims, damages, losses, or expenses arising from your use of the platform, your content, or violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which GathrUp operates, without regard to conflict of law principles.
